- To Enter: There are two ways to enter: i) An eligible Visa® cardholder will automatically be entered for one chance to win in each month that he/she makes one or more purchases with his/her individual Visa card between January 1, 2006 at 12:01 a.m. Eastern Time (ET) and December 31, 2006 at 11:59 p.m. ET (the “Contest Period”) posted to his/her individual account by the 6th business day of the month following the date of purchase (a “Qualifying Purchase”). An eligible Visa cardholder will receive one entry in each month of the Contest Period (each “Contest Month”) in which he/she has made a Qualifying Purchase. Cash advances, fees (including, without limitation, annual fees, NSF fees, over credit limit fees, etc.), convenience cheque transactions, balance transfers, automated teller machine (ATM) transactions, and returns shall not be considered to be Qualifying Purchases. Transactions made during the Contest Month but not posted to the applicable Visa account by the 6th business day of the month following the date of purchase shall not be considered to be Qualifying Purchases. Transactions made using Corporate, Purchasing and pre-paid Visa cards are not considered Qualifying purchases and are excluded from the Contest. The following are also excluded from being eligible for entry: a) purchases made by an unauthorized user and b) purchases made with Visa cards that are stolen, fraudulent, tampered with, or otherwise altered. A listing of VISA cardholder purchases made during the Contest Month and posted to a Visa account will be determined by the records of the winners’ financial institution. ii) NO PURCHASE REQUIRED: To enter without being a Visa cardholder or to enter as a Visa cardholder without purchase or obligation, hand-print your name, address, city, province or territory, postal code, day and evening telephone numbers, the Contest Month during the Contest Period for which you want your non-purchase entry entered in, and a 100-word or more handwritten essay on the “Value of having a Visa card”, and mail in a postage stamped envelope to: “Visa Win What You Buy”, PO Box 4099, Paris, Ontario, N3L 3W9. Visa cardholders must include the first 8 digits of their Visa account number for verification purposes. Maximum of one entry per envelope with sufficient postage. Non-purchase entries must be postmarked by the last day of the Contest Month for which you want your non-purchase entry entered and received by the Sponsor by the 6th business day of the month following the Contest Month. Maximum of one purchase entry (automatic entry) per Visa card or one non-purchase entry (mail-in entry) per person per Contest Month. In the event that a cardholder has been entered into the Contest for a particular Contest Month with a purchase and a non-purchase entry, the non-purchase entry will be considered void. No mechanical reproductions permitted. Entries become the property of Visa Canada Association (the “Sponsor”) and will not be returned.
- Drawing: A draw will be held each Contest Month for the prize awarded for each day of each Contest Month. Draws will take place at 11:00 a.m. in Winnipeg, Manitoba on the fourth Wednesday of the month following a Contest Month. One potential winner will be drawn at random for each day of the Contest Month (e.g., 31 winners in January, 28 winners in February, etc.) from among all eligible Visa cardholders who have made Qualifying Purchases with their Visa card during the Contest Month, or non-purchase entries designating the applicable Contest Month as the month for which such entry should be entered (“Selected Entrants”).
- Eligibility: The Contest is open to all Canadian residents who have reached the age of majority in the province or territory in which they reside as of the first day of the Contest Month in which they have entered and who are not an employee of, or living with an employee of, Visa Canada Association, its Member financial institutions, its affiliated companies, its representatives or agents, its advertising or promotional agencies, or the independent contest judging organization. Purchase entrants must be holders of a Visa card issued by a Canadian financial institution (the “FI”) prior to the first day of the Contest Month in which they have entered. A Visa cardholder may not be declared a winner unless his/her individual Visa account that matches exactly the Visa account that is drawn in the Contest is open and in good standing at the time of verification, and has net new billed purchases (purchases less returns) for the Contest Month greater than $0. Contest is void where prohibited or restricted by law. The Contest is subject to all applicable federal, provincial, and local laws and regulations. By participating, entrants agree to abide by and be bound by these Official Contest Rules and to accept the decisions of the Sponsor and the independent contest judging organization as final.
- Prizes: One prize will be available to be awarded for each day of each Contest Month during the Contest (365 prizes in total). Prizes will be awarded in Canadian dollars. Maximum value of each prize (individual prize) is $100,000 (Cdn.). Purchase Winners: Each prize will be awarded as a credit to the primary cardholder’s VIsa account. Purchase winners will receive the exact amount of total Qualifying Purchases made by the primary and any secondary cardholders posted to the primary cardholder’s Visa account during the Contest Month (less returns posted to that account during the applicable Contest Month) that matches exactly the Visa account that is drawn in the Contest to a maximum of $100,000 (Cdn.). Non-Purchase Entry (mail-in) Winners: Non-purchase entry winners will receive a cheque equal to the largest amount of total Qualifying Purchase transactions made by a purchase winner during the applicable Contest Month.
- Odds: The odds of winning a prize for each Contest Month depend on the total number of eligible Visa cardholders who have made a Qualifying Purchase during each Contest Month and the number of eligible non-purchase entries received and entered for each such Contest Month.
- Winner Notification/Prize Awards: The following process will be followed for each Contest Month (12 in total). Selected Entrants will be notified via courier or in person by the independent contest judging organization. In order to win any prize, each Selected Entrant must correctly answer, unaided, a time-limited, arithmetical, skill-testing question and sign and return the Sponsor’s standard Declaration and Release Form within 22 days from the time the prize notification is postmarked as having been sent by the independent contest judging organization. The skill-testing question and the Declaration and Release Form will be included in the prize notification package from the independent contest judging organization. Non-responding Selected Entrants will be notified by phone at the two primary telephone numbers (as indicated on their Visa account records maintained on their FI’s system) between the 11th and 14th, and 17th and 20th days following the initial notification. No messages will be left and the independent contest judging organization must speak directly to the Selected Entrant. The prize will be forfeited and awarded to an alternate winner if the prize notification is returned as non-deliverable or if the Declaration and Release Form, including skill testing question, is not returned within 22 days from the time the prize notification package is postmarked as having been sent by the independent contest judging organization. In the event the alternate winner does not return the required documentation within 22 days (following the procedures set forth above) the prize will be forfeited and not awarded to any further alternates.
- Additional Terms: By participating, entrants agree to a) these Official Contest Rules and the decisions of the independent contest judging organization and the Sponsor which shall be final in all respects; and b) release, discharge, indemnify and hold harmless Visa Canada Association, Visa International Service Association, each of their respective Member financial institutions (including all FIs), each of their respective subsidiaries, affiliates, officers, directors, and employees, including their promotional agencies and the independent contest judging organization, from any liability, claims, or damages, demands, actions, or causes of action whatsoever which they, their heirs, successors, assigns, executors, or administrators may now or hereafter have directly or indirectly against them or any of them in respect of or relating to the Contest and/or the acceptance or use, misuse, or possession of any prize. By accepting a prize, winners agree to the Sponsor’s and its designees’ use of their names, city, province or territory of residence and/or photograph for advertising and publicity purposes without compensation.
- Limitation of Liability: The Sponsor and each FI shall not be responsible for print or typographical errors in any Contest-related materials; for stolen, lost, late, misdirected, damaged, incomplete, illegible, or postage-due non-purchase entries; or for transactions that are posted late or incorrectly or are lost due to computer or electronic malfunction. The Sponsor reserves the right, subject to the approval of the Régie des alcools, des courses et des jeux du Québec, to cancel or modify the Contest if fraud or technical failures compromise the integrity of the Contest as determined by the Sponsor in its sole discretion.
- Privacy Policy: By entering this Contest, you consent to the Sponsor, its promotional agencies, contest administrator, and the independent contest judging organization storing and using the personal information submitted through automatic entry for the purpose of administering the Contest in accordance with these Official Contest rules.
- For Québec Residents Only: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux du Québec for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
